Collectively referred to as the "Parties."

 

Recitals

 

WHEREAS, Breeder is the lawful owner of the following described puppy:

NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

 

Purchase Price

 

The Buyer shall pay the Breeder a non-refundable deposit of 20% to secure the puppy. This deposit shall be applied toward the total Purchase Price. Female puppies will be sold for $2,800 and male puppies shall be sold for $2,500.

The Buyer shall pay the remaining balance to the Breeder 24 hours before the date of delivery or pickup of the puppy.

All payments shall be made in Venmo, cash, or Zelle to the breeder.

 

Delivery & Pickup

 

The puppy shall be (Delivered/Picked Up) by the Buyer on or before the puppy turns 12 weeks. Any additional expenses related to the delivery of the puppy, including but not limited to transportation costs, health certificates, and crate fees, shall be the Buyer's responsibility.

 

Health Warranty

 

Health Representation

 

To their knowledge, the Breeder represents that the puppy being sold under this contract is in good health at the time of transfer. The Breeder further represents that the puppy has received appropriate vaccinations, is free from known contagious diseases, and has been examined by a licensed veterinarian. Vaccinations include DHPP booster, Leptospirosis, and rabies as well as deworming.

 

Examination Period

 

The Buyer agrees to have the puppy examined by a licensed veterinarian within 2 days of the sales date. We recommend Jericho Animal Hospital in Jericho, NY. If the veterinarian determines the puppy to be unfit for purchase due to a pre-existing health condition, the Buyer must provide written notice to the Breeder within 24 hours of the examination date. Proof of such medical discovery must be provided as well. The Breeder will give one weeks’ notice of delivery date of said puppy. It is the Buyer’s responsibility to have a veterinary appointment already scheduled that meets the time frame of said reported exam.

 

Breeder's Responsibility

 

If, within 2 days from the date of transfer, a licensed veterinarian certifies that the puppy is unfit for purchase due to a congenital or hereditary health issue, the Breeder agrees to replace the puppy with one of equal value, subject to the availability of such a replacement. Or The Buyer may choose to retain the puppy at their own expense, The buyer also has the option of returning the puppy to the breeder and a 50% refund will be issued plus the cost of the vet exam.

 

Exceptions

 

This warranty does not cover conditions resulting from neglect, accidents, injury, or any other circumstances beyond the control of the Breeder. This warranty does not cover common and non-serious conditions such as parasites, external parasites, ear mites and other minor ailments.

 

Limitations

 

The Breeder's liability under this warranty is limited to the puppy's purchase price. The Breeder is not responsible for any consequential damages, including but not limited to veterinary expenses, emotional distress, or loss of income.

Notice

 

Any claims under this warranty must be submitted in writing to the Breeder within 2 days of the Buyer's discovery of the health issue. Failure to provide timely notice shall void this warranty.

 

Miscellaneous

 

This warranty constitutes the entire agreement between the Parties and supersedes all prior negotiations, understandings, or agreements, whether written or oral. Any modifications to this warranty must be in writing and signed by both Parties.

 

Registration

 

Registration Authority

 

The Breeder agrees to provide the Buyer with the necessary documentation to register the above-described puppy with the appropriate canine registration authority, such as the American Kennel Club (AKC) or another recognized breed registry if applicable.

 

Transfer of Ownership

 

The Breeder agrees to promptly transfer ownership of the puppy to the Buyer upon receipt of all necessary information and fees required by the registration authority. The Buyer agrees to provide the Breeder with accurate information for the registration, including the desired registered name and any other required details.

 

Registration Fees

 

The Buyer shall  be responsible for all costs associated with the registration process, including but not limited to registration fees and any additional expenses required by the registration authority. The Breeder shall not be held liable for any delays or issues arising from the registration process.

 

Breeder's Responsibilities

 

The Breeder warrants that, at the time of transfer of ownership, the puppy's registration papers shall be free from any restrictions except as otherwise specified in this Agreement.

 

Non-Transferable Registration

 

The Buyer agrees not to transfer or attempt to transfer the registration of the puppy to any third party without the express written consent of the Breeder. Any unauthorized transfer of registration shall be considered a breach of this Agreement.

 

Return of the Puppy

 

If the Buyer is unable or unwilling to keep the puppy, the Buyer agrees to offer the Breeder the option to rehome or reassume ownership of the puppy before exploring alternative arrangements. No refunds will be applied.

 

Indemnification

 

The Buyer agrees to indemnify and hold the Breeder harmless from any liability, claims, damages, or expenses arising from the Buyer's actions or omissions concerning the puppy.
